Andrew Lugg (Political Science) recently published an article titled, "Why is there no investor-state dispute settlement in RCEP? Bargaining and contestation in the investment regime," in the journal Business and Politics. Available here: . The article seeks to understand why investor state dispute settlement, which was commonly included in many international economic treaties up until recently, was not included in the recently negotiated Regional Comprehensive Economic Partnership (RCEP). We show that in protracted international negotiations domestic politics, eroding legal norms, and exposure to additional legal disputes can contribute to the exclusion of treaty provisions that were once viewed as desirable.
